Foreclosure sale date set in Minnesota: what you can still do

If your Minnesota sheriff's sale is scheduled, you still have options until the sale itself. You can reinstate, get a complete loss mitigation application in before the 7th business day cutoff, or, if you act at least 15 days ahead, record a postponement affidavit. Start by confirming the date with the county sheriff's office.

Tell us your sale date

Free. A person replies with the options and official help that fit. Messages about a scheduled sale are answered first.

For example: a sale date, what your servicer has told you, or what changed in your income. Please do not include your loan number, Social Security number or bank details.

Free, and there is nothing to buy. A person reads your message and replies by email, or by phone if you leave a number. We never ask for a fee and we do not sell your details. See the privacy policy.

Options still open before a sale in Minnesota

  • Confirm the sale is still on

Today, and again the day before the sale

The date, time and place are in your foreclosure advice notice. If the lender postpones, it must publish the new date once in the same newspaper and mail you notice within three business days. Call the sheriff's office in the county where the home is.

    Minn. Stat. §§ 580.041, 580.07, subd. 1

  • Send a complete loss mitigation application

Before midnight of the 7th business day before the sale

If the servicer receives it in time, it must halt the sale and review it, and after any denial it must wait 60 days before selling. Send it in a way you can prove, and keep copies.

    Minn. Stat. § 582.043, subd. 6(c)

  • Reinstate the loan

Before the sale; ask for the figure at least 3 days ahead

Pay the amount in default plus allowed costs to the lender, its attorney or the sheriff. The lender does not have to postpone for a request made less than three days before the sale, and each quote is good for seven days.

    Minn. Stat. § 580.30

  • Record a postponement affidavit

At least 15 days before the sale date

If the home is your homestead with one to four units, record the affidavit and deliver copies to the sheriff and the foreclosing attorney. This moves the sale 5 months later but cuts your redemption period to five weeks.

    Minn. Stat. § 580.07, subd. 2

  • Talk to a bankruptcy attorney

Before the sale, not at the last minute

Filing pauses the sale through the automatic stay. Get advice from a licensed bankruptcy attorney or legal aid first.

    11 U.S.C. § 362(a)

  • Plan to redeem

Within the redemption period after the sale

If the sale happens, you can still buy the home back, usually within six months. If there is a surplus, you can ask the sheriff in writing to apply it to the redemption amount.

    Minn. Stat. §§ 580.23, 580.10, subd. 3

Common questions in Minnesota

What is the last day to file Minnesota's sale postponement affidavit?

At least 15 days before the sale date in the published notice, under Minn. Stat. § 580.07, subd. 2. You must sign it under oath, record it in each county office where the mortgage was recorded, and file a copy with the sheriff and give one to the foreclosing attorney. The Minnesota courts' foreclosure page links to the form.

Can I still apply for a modification if my Minnesota sale is next week?

If the servicer receives your application before midnight of the seventh business day before the sale, Minn. Stat. § 582.043 requires it to halt the sale and review it. After that cutoff the state law does not require a halt, but you can still ask the servicer and its attorney in writing to postpone.

Can the Minnesota sheriff postpone my sale?

In one situation. Under Minn. Stat. § 580.30, subd. 2, if the sheriff asks the lender in writing for payoff and reinstatement figures and the lender does not answer within seven days, the sheriff must postpone the sale and announce it at the sale. Otherwise postponements come from the lender or your affidavit.
