Foreclosure deadline calculator

Federal rules give you protections on set days: when your servicer must contact you, the earliest a foreclosure can start, and the last day an application can stop a sale while it is reviewed. Enter your dates to see yours.

The first unpaid payment, for example the 1st of the month you missed.
It is on your notice of sale, or ask the trustee, sheriff or court.

Nothing you enter leaves this page. These are federal minimums; your state may give you more time.

Enter the date of your oldest missed payment, your sale date, or both. Your federal protection dates will appear here.

How these dates are counted

The federal servicing rules count the due date of your oldest unpaid payment as day 0. A payment due January 1 and not paid is 30 days behind on January 31. The sale-date cutoffs count back from the sale and depend on when your servicer receives your application, so send it in a way you can prove and ask the servicer to confirm in writing that it is complete.

These are federal minimums. Your state may add notices, mediation or a right to catch up that give you more time. See your state’s page and your federal rights for the full rules.

Common questions

Why does the 37-day date matter so much?

If your servicer receives a complete loss mitigation application more than 37 days before a scheduled sale, federal rules require it to review you for every option within 30 days, and it cannot hold the sale while that review, any appeal and your time to accept are running. An application received 37 days or fewer before the sale does not get that protection, though you should still apply.

Do these dates apply to my loan?

They apply to a mortgage on your main home. Small servicers (roughly 5,000 loans or fewer that they or an affiliate own) are exempt from most of them but must still follow the 120-day rule. Reverse mortgages are not covered. If you are unsure, ask your servicer or a HUD-approved counselor.

What if I made a partial payment?

Many servicers apply payments to the oldest missed payment first, which moves your delinquency date forward. Use the due date of the oldest payment that is still unpaid in full. Your mortgage statement shows it.
