Renting a home that was foreclosed in Wyoming: your rights
If you rent a home in Wyoming and your landlord's mortgage is foreclosed, the federal Protecting Tenants at Foreclosure Act is your main protection: at least 90 days' written notice after the foreclosure, and often the rest of your lease. We did not find a Wyoming statute that gives renters more notice after a foreclosure. Wyoming law does protect occupied space during the 3-month redemption period after a sale, requires a court case before anyone can remove you, and makes whoever owns the home when your lease ends responsible for your deposit.

Your rights as a renter in Wyoming, in order
Federal floor: 90 days' notice, and your lease may continue
After full title passes to the buyerA bona fide tenant gets at least 90 days' written notice to vacate, and a lease signed before the foreclosure runs to its end unless the buyer will live in the home. Under the federal law, the foreclosure date is when full title passes, which in Wyoming is usually the sheriff's deed after redemption ends. If you have a Section 8 voucher, the new owner takes over your lease and housing assistance contract. See [tenant notice after foreclosure](/notices/tenant-notice-after-foreclosure/).
Pub. L. 111-22 § 702; Pub. L. 115-174 § 304; 42 U.S.C. § 1437f(o)(7)
During the 3-month redemption period
3 months after the saleAfter a Wyoming foreclosure sale of a home, the owner has 3 months to redeem. During the redemption period, the buyer has only a limited right to enter parts of the property that no one is living in, to keep it from deteriorating. Keep paying rent as your lease requires to the landlord or the party you confirm in writing, and keep receipts.
Wyo. Stat. §§ 1-18-103(a), 1-18-111(b)
Removal takes a 3-day notice and a court case
At least 3 days before a case is filedA new owner who wants possession must serve a written notice to leave at least 3 days before filing a forcible entry and detainer case, and the summons must be served 3 to 12 days before trial. You do not have to file a written answer to take part in the trial. A 3-day notice does not cancel the federal 90-day notice a bona fide tenant is owed, so bring your lease and notices to court.
Wyo. Stat. §§ 1-21-1002, 1-21-1003, 1-21-1004
Your deposit: the owner at the end of your lease is responsible
30 days after the lease ends, or 15 days after you give a new addressWhoever holds the owner's interest when your rental agreement ends is bound by Wyoming's deposit law. The deposit balance and a written list of deductions are due within 30 days after the agreement ends or 15 days after the owner gets your new mailing address, whichever is later, with 30 more days if there is damage. Give your new address in writing within 30 days after the lease ends.
Wyo. Stat. §§ 1-21-1208(a), 1-21-1209
Ask who owns the home before paying anyone new
As soon as you hear about a saleWe did not find a Wyoming statute that tells a renter who to pay after a foreclosure. Ask in writing for the new owner's name, address and proof of ownership, check the county clerk's land records, and keep paying under your lease to the party you confirm. Legal Aid of Wyoming can help if you are unsure.
Common questions in Wyoming
The new owner of my Wyoming rental gave me a 3-day notice. Do I have to leave in 3 days?
Usually not. A 3-day notice to quit is the step before a Wyoming eviction case (Wyo. Stat. § 1-21-1003), not a court order. If you are a bona fide tenant, federal law usually requires at least 90 days' written notice after the foreclosure, and possibly the rest of your lease. Go to any court date and call Legal Aid of Wyoming.
Who returns my security deposit after my Wyoming landlord's foreclosure?
Under Wyo. Stat. § 1-21-1209, whoever holds the owner's interest when your rental agreement ends is bound by the deposit rules, which after a completed foreclosure is usually the new owner. Send your new mailing address in writing within 30 days after you move.
Can the foreclosure buyer come into my Wyoming rental during the redemption period?
Only in a limited way. Wyo. Stat. § 1-18-111(b) gives the buyer a limited right to enter parts of the property that are not occupied by a legal inhabitant, to protect it from damage. It does not let the buyer enter the space you live in or remove you without a court case.
