Foreclosure sale date set in Montana: what you can still do

If a Montana trustee's sale is scheduled, you still have until the time set for the sale to cure the default. Act in days, not weeks. Confirm the sale status with the trustee named on your notice.

Tell us your sale date

Free. A person replies with the options and official help that fit. Messages about a scheduled sale are answered first.

For example: a sale date, what your servicer has told you, or what changed in your income. Please do not include your loan number, Social Security number or bank details.

Free, and there is nothing to buy. A person reads your message and replies by email, or by phone if you leave a number. We never ask for a fee and we do not sell your details. See the privacy policy.

Options still open before a sale in Montana

  • Pay the cure amount

Before the time set for the sale

Ask the trustee for a written reinstatement figure and pay it with certified funds as instructed. Paying the past-due amount, costs and fees cancels the foreclosure.

    Mont. Code Ann. § 71-1-312

  • Ask the servicer to postpone

    Before the sale

A servicer reviewing a complete loss mitigation application, or a pending sale or refinance, may agree to postpone. The person conducting the sale can postpone for up to 15 days by announcing it at the sale. Get any promise in writing.

    Mont. Code Ann. § 71-1-315

  • File bankruptcy

    Before the sale is held

The automatic stay stops the sale while it is in effect. Speak with a bankruptcy lawyer before filing, because it has lasting effects.

    11 U.S.C. § 362

  • Ask the district court for an order

    Before the sale

If the notice or the recorded documents do not meet the statute, a lawyer can ask the district court to stop the sale. This needs a lawyer and usually has to be filed days ahead.

    Mont. Code Ann. §§ 71-1-313, 71-1-315

  • Confirm whether the sale is still on

The day before and the morning of the sale

Call the trustee or trustee's attorney named on the Notice of Trustee's Sale. The notice is also recorded with the county clerk and recorder, and it lists the sale place: the courthouse, the property, or the trustee's office.

    Mont. Code Ann. § 71-1-313

Common questions in Montana

What is the last moment I can reinstate my loan in Montana?

Up to the time fixed by the trustee for the sale, under Mont. Code Ann. § 71-1-312. In practice, arrange payment days ahead, because the trustee needs time to confirm certified funds.

Where are Montana trustee's sales held?

At the courthouse of the county where the property is located, at the property itself, or at the trustee's usual place of business in that county, between 9 a.m. and 4 p.m. Your notice of sale states the exact place and time.

If my Montana trustee's sale is postponed, will I get a new notice?

Not necessarily. A postponement of up to 15 days can be announced out loud at the time and place of the original sale, with no other notice. Call the trustee to learn the new date.
