How long does foreclosure take in Delaware?

A Delaware foreclosure usually takes several months after the case is filed. Legal Services Corporation of Delaware says it averages 5 to 6 months from filing to confirmation of the sale. Before that come the federal 120-day wait and Delaware's 45-day notice, which usually run at the same time.

The short answer: At the very least, expect the federal 120-day wait (the 45-day Delaware notice of intent to foreclose usually runs inside it) plus the court case. A mediation conference is set 45 to 75 days after you are served, and the lender cannot seek judgment until after that date. Legal Services Corporation of Delaware says the court part averages 5 to 6 months from filing to confirmation of the sale. This is a minimum, not a prediction.

The foreclosure timeline in Delaware, phase by phase

  1. Missed payments and the 45-day notice

Day 1 to about Day 120 or later

The lender generally cannot file until after the federal 120-day wait, and in Delaware it must also wait 45 days after mailing the Notice of Intent to Foreclose. The two periods often overlap.

    10 Del. C. § 5062B; 12 C.F.R. § 1024.41(f)

  2. Service and the first 30 days

    First 30 days after service

Meet a housing counselor and file the Certificate of Participation within 30 days. Legal aid says to answer within 20 days, but in a mediation case the law says your answer is not late if filed by the mediation conference date.

    10 Del. C. §§ 5062C(e), 5062D(c)

  3. Mediation conference

45 to 75 days after service

Send the lender and mediator your financial worksheet at least 14 days before. More conferences can be added if a deal is in progress or the lender fails to show, which adds time.

    10 Del. C. § 5062C(d), (f)

  4. Judgment

No earlier than the day after the scheduled conference

The lender also must file a sworn affidavit that you had a chance to apply for loss mitigation. A contested case with a scheduling order takes longer than a default.

    10 Del. C. §§ 5062A, 5062C(c)

  5. Sheriff's sale

At the county's monthly sale, after at least 10 days' notice

Each county sheriff holds sales on a set monthly schedule. In Sussex County they are on the third Tuesday of the month.

    10 Del. C. § 4973

  6. Confirmation

About a month after the sale

The Sussex County Sheriff says confirmation happens on the first Friday after the third Monday of the month after the sale. Objections must be raised before then.

    10 Del. C. § 5065

  7. Moving out

    Weeks to months after confirmation

Legal aid says a lender that bought the home can get a writ of possession in a matter of weeks, while an outside buyer must file an ejectment case that takes months.

Common questions in Delaware

How long does a Delaware sheriff's sale take after the lawsuit is filed?

Legal Services Corporation of Delaware says the court part averages 5 to 6 months from filing to confirmation of the sale. Mediation alone sets a conference 45 to 75 days after you are served. Extra conferences, a contested answer or a bankruptcy can make it longer.

Does the Delaware 45-day notice add time to the federal 120 days?

Usually not much. The lender can mail the Notice of Intent to Foreclose while the federal 120-day wait is running, and then cannot file until 45 days after mailing it. So the earliest filing is often just after Day 120.

When is the sheriff's sale confirmed in Delaware?

In Sussex County, the sheriff says confirmation is the first Friday after the third Monday of the month after the sale. New Castle and Kent follow their own posted schedules, so ask the sheriff's office in your county.
